Terms of Service

These Terms of Service apply to the MonoMood mobile application, developed and published by Michael Guggenberger.

1. Scope

These terms apply to your use of MonoMood. By downloading and using the app, you accept these terms.

2. Description of Service

MonoMood is a private mood diary for one daily mood entry on a scale from 1 to 5, optional notes, tags, history, statistics, and reminders. The app stores your diary locally in SQLite on your device. There is no MonoMood user account and no MonoMood backend for your diary data.

3. Usage Rights

By downloading MonoMood, you receive a non-exclusive, non-transferable right to use the app for private purposes on your own devices.

4. Voluntary Support Purchases

MonoMood is free and ad-free. Optional one-time support purchases are voluntary tips that help fund development. They unlock no features, remove no limits, and create no entitlement state. Purchases are processed by Apple's App Store or Google Play and are subject to their respective terms and refund policies.

5. Reminders, App Lock, and Backups

MonoMood may offer local reminders, optional device-authentication App Lock, manual CSV export, passphrase-protected encrypted .mmbackup files, and optional automatic encrypted snapshots. You are responsible for keeping exported files, backup destinations, and backup passphrases safe. MonoMood cannot recover lost passphrases.

6. Liability

MonoMood has been developed with care. However, errors, interruptions, data loss, or incorrect reminder behavior cannot be fully excluded. To the extent permitted by law, liability for damages arising from use of the app is excluded; mandatory statutory liability remains unaffected.

7. Data Protection

Our Privacy Policy applies. MonoMood stores diary data locally by default. Diary data leaves the device only when you explicitly export it or choose a backup destination. It is never uploaded to a MonoMood server.

8. Changes to these Terms

Michael Guggenberger may update these terms where required for legal, technical, or organisational reasons. The published version in effect applies.

9. Governing Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rights in your country of residence remain unaffected.

The controller for MonoMood is Michael Guggenberger, Straßganger Straße 58, 8052 Graz, Austria. You can contact us by email at info@miguapps.com. No data protection officer has been appointed.

2. Visiting this website

When you visit this website, the web server processes technically necessary access data so that the site can be delivered, operated reliably, and protected against misuse. This includes your IP address, request date and time, requested URL or file, status code, referrer URL, browser, operating system, and user agent. The website is hosted by Vercel Inc.; Frankfurt am Main, Germany, is configured as its region. The legal basis is our legitimate interest in secure and reliable operation under Article 6(1)(f) GDPR. The website uses only the technically necessary NEXT_LOCALE session cookie for the language version you select. No non-essential cookies, accounts, forms, advertising, or analytics scripts are used.

3. Contact by email

If you contact us by email, we process your email address, message, attachments, and technical communication data to respond to your request. We use Apple's iCloud Mail for email communication. Depending on the subject, the legal basis is Article 6(1)(b) GDPR for pre-contractual or contractual communication, or Article 6(1)(f) GDPR based on our legitimate interest in handling enquiries.

4. Local storage and app functions

By default, MonoMood stores the data you enter locally on your device: mood ratings, free-text notes, tags, entry dates, and the settings needed for themes, language, reminders, App Lock, and backups. Diary data is stored in SQLite. There is no MonoMood account and no MonoMood server for this data, and we cannot access your diary. A mood diary and free-text notes can contain sensitive personal information, including information related to health. Diary content leaves the device only through an export you explicitly trigger, an automatic encrypted snapshot you explicitly configure, or an operating-system device backup as described in section 8. The app never uploads it to MonoMood.

5. Reminders and App Lock

MonoMood can use notification permission to schedule local daily reminders. It does not use a MonoMood push server. If you enable App Lock, MonoMood uses Face ID, fingerprint, or your device passcode; it receives no raw biometric data, only whether authentication succeeded.

6. Manual export, import, and backups

You can export your diary as a plaintext CSV file or as a passphrase-protected encrypted .mmbackup file. A CSV export is not encrypted and stays in the app's export folder until you delete it, so treat it like any other unprotected copy of your diary. MonoMood reads only files you explicitly select for import, and the temporary copy the system file picker creates is deleted again as soon as the file has been read. Automatic encrypted snapshots are optional and can be written to your device, an Android folder you select, or iCloud Drive on iOS. The diary content is encrypted before an automatic snapshot leaves the app, and MonoMood operates no server for these destinations.

7. Backup passphrase and deletion

Your backup passphrase is not sent to us and cannot be recovered. When you switch automatic backups on, MonoMood stores a key derived from that passphrase in your device's secure storage (iOS Keychain, Android Keystore) so that a daily snapshot does not have to ask you for the passphrase again; the passphrase itself is never stored. Deleting all entries in the app removes this key, every export file, and every snapshot stored on the device itself, and switches automatic backups off. Snapshots you have written to an Android folder or to iCloud Drive are outside the app and remain there until you delete them.

8. Operating-system device backups

Apple and Google back up app data as part of their own device backup and device transfer features, independently of MonoMood's backup function. On Android, MonoMood's backup rules limit this to app settings such as theme, language, and reminder time; the diary database, export files, and snapshots are excluded from Google's Auto Backup and from device-to-device transfer. On iOS, export files and on-device snapshots are excluded from the iCloud device backup, but the diary database itself is included, so that restoring a new iPhone from an iCloud backup also restores your diary. MonoMood has no server that could restore it otherwise. That backup is held in your own iCloud account under Apple's terms and encryption, and we have no access to it. You can switch iCloud backup off for MonoMood in the iOS settings.

9. In-app purchases

MonoMood's only store products are optional, repeatable support tips. Apple or Google process payments, store accounts, and refunds under their own terms and privacy policies. MonoMood handles only the technical information required locally to complete and consume a purchase. Support purchases unlock no features and do not change how diary data is handled.

10. No advertising or analytics tracking

MonoMood and this website contain no advertising, analytics tracking, or third-party tracking scripts. No diary data is collected for marketing or analytics purposes.

11. Retention and recipients

Local app data remains on your device until you delete it in the app, remove the app, or your device deletes it; operating-system device backups follow the rules of section 8. Exports and backups remain under your control at their chosen destination. Server access data for this website is deleted or anonymised after 30 days at the latest. We keep email correspondence for as long as we need it to handle your request and for up to two years afterwards, unless statutory retention obligations require longer. Recipients may include Vercel Inc. for website hosting, Apple for iCloud Mail and iCloud Drive, and Apple or Google for store and operating-system functions.

12. Transfers to third countries

Vercel Inc. and Apple Inc. are based in the United States, so the processing described above can involve a transfer of data to a third country. These transfers are based on the European Commission's standard contractual clauses and, where the recipient is certified, on the EU-US Data Privacy Framework. Diary content is not part of these transfers unless you choose iCloud Drive as a backup destination yourself, in which case it is encrypted before it leaves the app.

13. Your rights

Under the GDPR, you have rights of access, rectification, erasure, restriction, portability, objection, and complaint with a supervisory authority. The competent authority in Austria is the Datenschutzbehörde, Barichgasse 40-42, 1030 Vienna. Because MonoMood does not receive your diary data, you can exercise many of these rights directly in the app. MonoMood is not directed at children and we do not knowingly process data from children under 16.
